HIPAA Notice of Privacy Practices.

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Federal law provides you with certain rights. https://www.hhs.gov/hipaa/for-individuals/notice-privacy-practices/index.html. This HIPAA Notice of Privacy Practices explains your rights and some of our responsibilities to help you.

Your Rights as Parent to Child Receiving Kidlet Oral Appliance Program. When it comes to your child’s health information, you have certain rights. This section explains your and your child’s rights and some of our responsibilities to help you. You have the right to:

  1. Get an electronic or paper copy of your child’s medical record;

  2. Ask to see or get an electronic or paper copy of your medical record and other health information we have about you/your child. Ask us how to do this. 

  3. Obtain a copy or a summary of your child’s health information, usually within 30 days of your request. We may charge a reasonable, cost-based fee. 

  4. You may ask us to correct your child’s medical record or to correct health information about your child that you believe is incorrect or incomplete. Ask us how to do this. We may say “no” to your request, but if so then we will tell you why in writing within 60 days.

  5. Request confidential communications. You can ask us to contact you in a specific way (for example, home or office phone) or to send mail to a different address.  We will say “yes” to all reasonable requests.

  6. Ask that we limit the information that we share with others. You can ask that we not share or use certain health information for treatment, payment or our operations. We are not required to agree with your request and may decline if limiting the information we share would affect your care. If you pay for a service or health care out of pocket and in full, then you can ask that we not share that information for the purpose of payment or our operations with your health insurer. Unless required to share the information by law we will agree not to share such information.

  7. Get a list of those with whom we have shared information. You can ask for a list (accounting) of the times that we have shared your health information for six years prior to the date you ask, whom we shared it with, and why. If so, then we will include all the disclosures except for those about treatment, payment, and health care operations, and certain other disclosures (such as any you asked us to make). We will provide one accounting a year for free but will charge a reasonable, cost-based fee if you ask for another one within 12 months.

  8. Receive a hardcopy of this Privacy Notice. You can ask for and receive a paper copy of this notice at any time and even if you have agreed to receive the notice electronically.

  9. You may designate someone to act on your behalf. If your child has given someone medical power of attorney or if someone else is also your child’s legal guardian, then that person may exercise your parental rights and make choices about your child’s health information. We will make sure that person has this authority and can act on your child’s behalf before we take any action.

  10. You may file a complaint if you believe that your or your child’s privacy rights have been violated. You can complain to us and also to the Secretary of the Department of Health and Human Services (HHS) if you believe that we have violated your or your child’s privacy rights. You can inform us of your concern or complaint by sending an e-mail to info@mykidlet.com.

  11. If you have a preference for how we share your information with your family, close friends, or others involved in your/your child’s care, then please let us know and we will follow your instructions. We will not sell or share your information for marketing purposes unless you have given us written permission to do so.

OUR USES AND DISCLOSURES

We may use and share your/your child’s information for the purpose of:

  1. Providing treatment. We may use your child’s health information and share it with other professionals who are treating your child, for example, a dentist prescribing your child’s oral appliance device may ask another dentist or doctor about your overall health condition.

  2. Running our organization. We may use and share your child’s health information to run our business, improve your care, and contact you when necessary. By way of example, we may use your child’s health information to assist your child’s dentist in your treatment and the administrative services that we provide.

  3. Billing for products or services. We can use and share your/your child’s health information to bill and get payment from health plans or other entities. For example, your health insurance plan may require that we provide it with information about you/your child in order for it to pay for some or all of the ordered products or services.

  4. Assisting with public health and safety issues. The law allows or requires us to share your or your child’s information in certain ways intended to benefit the common good of the public, such as research or for the public health, such as to prevent disease, assist with product recalls, report adverse reactions, report suspect abuse or neglect or domestic violence, and/or to prevent or reduce a serious threat to anyone’s health or safety.   5. Performing or participating in research. We may use or share your or your child’s information for health research purposes.

  6. Performing legal compliance. We will share information about you or your child if state or federal laws require us to do so, including the Department of Health and Human Services, if it wishes to check and confirm that we are complying with federal privacy laws, including HIPAA.

  7. Responding to requests from worker’s compensation bureau, law enforcement or other government requests; and

  8. Responding to legal claims, actions or lawsuits. We can share information about you and/or your child in response to a lawsuit, subpoena, court or administrative order.

Our Responsibility to Maintain the Privacy and Security of Your/Your Child’s PHI. 

Federal law requires that we maintain the privacy and security of your/your child’s protected health information (PHI). We are required to let you know promptly if a breach occurs that may have compromised the privacy or security of your information. We must follow the duties and privacy practices described in this notice and give you a copy of it. We will not use or share your information other than as described here unless you tell us we can in writing. You can change your preferences and if you wish to do so, then please let us know in writing. CHANGES TO THE TERMS OF THIS HIPAA NOTICE OF PRIVACY PRACTICES

We may update and change the terms of this Notice. Any such update or changes will apply to all information we have about you and/or your child. The new, updated Notice will be available upon request in our office and/or on our website.
